Loan & mortgage law
Advice on loan documents, mortgages and guarantees. We explain obligations and risks before signing, and assist with independent legal advice and solicitor certificates where appropriate.
01
How we can help
- Loan document advice: explain obligations and risks before you sign.
- Independent advice: consider your position as a borrower or guarantor.
- Documentation: assist lenders and borrowers with the agreed transaction documents.
02
Specific matters we can assist with
Understanding your loan documents
Discuss how the proposed loan will work: amounts advanced, interest, fees, repayment dates and conditions to meet before funds are released. Bring the full pack so related clauses can be read together.
Mortgages and security over property
Identify which assets secure the loan and what the mortgage documents say about obligations, restrictions and enforcement. We can explain how the proposed security relates to the underlying debt.
Guarantors and independent legal advice
Explain the proposed guarantee, indemnity and scope of liability, including circumstances in which payment may be demanded from a guarantor and whether obligations continue after a change to the loan.
Signing and solicitor certificates
Review the lender’s requirements, confirm the advice and identity documents needed, and assist with signing or a solicitor certificate where appropriate. Advice must be completed before the relevant certificate can be given.
Private lending and loan agreements
Help record the amount, purpose, repayment terms and agreed security for a private or commercial loan. Discuss unclear terms and the documents needed before money is advanced.
Refinancing, changes and repayment disputes
Review variations, refinancing, releases of security and disputed balances. If payments are overdue, discuss notices, negotiation and possible recovery or response steps.

Common questions
Can you explain the documents before I sign?
Yes. Send the complete pack and identify your role in the transaction. We can explain the terms and discuss questions to resolve before signing.
Can you complete a solicitor certificate?
Send the lender’s instructions and certificate first. We will confirm whether we can meet the requirements and provide the necessary advice before completing a certificate where appropriate. This does not guarantee loan approval or financial suitability.
Discuss your circumstances
Tell us what you need help with, any relevant dates and your preferred language. We will discuss the matter and confirm the available assistance and engagement arrangements.
